Service Terms & Participant Agreement

1. INTRODUCTION AND APPLICATION OF TERMS

 

These Service Terms and Participant Agreement (“Agreement”) apply to all services provided by I Learn for Life, operated by Rosemi Fitchett,

Registered Psychologist and sole trader (“we”, “us”, “our”).

 

This Agreement applies to all participants engaging in any of the following services:

  • Grow a CALMER Mind Program

  • 1:1 Thinking Partner Sessions

  • Career Direction Program

  • Workshops, webinars, and related educational offerings

  • Any associated digital resources, recordings, or learning, social media platforms

 

By purchasing, enrolling in, accessing, or participating in any service, you agree to be bound by this Agreement.

 

2. NATURE OF SERVICES (IMPORTANT NOTICE)

 

All services provided by I Learn for Life are:

  • educational in nature

  • reflective and psychoeducational in design

  • focused on learning, insight, and structured thinking

 

These services are NOT:

  • clinical, therapeutic services, psychotherapy or counselling

  • psychological treatment or diagnosis

  • crisis intervention or emergency support

  • a substitute for mental health care or medical advice

 

Participation in services does not create a psychologist-client, therapeutic, or healthcare relationship.

 

You acknowledge that services are designed to support learning and reflection rather than treatment or clinical intervention.

 

3. SUITABILITY AND PARTICIPATION RESPONSIBILITY

 

By participating, you acknowledge that you are responsible for determining whether the services are appropriate for your circumstances.

 

These services may not be suitable for individuals who are:

  • experiencing acute psychological distress

  • in crisis or at risk of harm

  • requiring clinical psychological treatment or diagnosis

  • needing urgent mental health or medical support

You agree that you will seek appropriate professional support where needed, including medical, psychological, or emergency services.

We reserve the right to recommend referral to external practitioners where participation is not appropriate or where needs exceed the scope of these services.

 

4. SERVICE DELIVERY

 

Services may be delivered via:

  • Zoom or other video conferencing platforms

  • online learning platforms (LMS)

  • digital content modules

  • live group sessions

  • 1:1 sessions

  • downloadable materials

  • email communication

 

Program structure may include:

  • guided learning modules

  • reflective exercises

  • structured thinking frameworks

  • facilitated group discussions

  • optional homework or integration activities

 

Participants are responsible for their own engagement with materials and exercises.

 

5. RECORDING, TRANSCRIPTION, AND SESSION USE

 

5.1 Recording Consent

 

You acknowledge and consent that sessions (including group and 1:1 sessions where applicable) may be:

  • video recorded

  • audio recorded

  • transcribed

  • summarised using automated or AI-assisted tools

 

5.2 Purpose of Recording

 

Recordings and transcripts may be used for:

  • participant replay and access

  • educational review and learning reinforcement

  • creation of summaries and action plans

  • program delivery improvement

  • internal quality assurance

 

 

5.3 Access

 

Where applicable, participants may be given access to:

  • session recordings

  • transcripts

  • summaries or action plans derived from sessions

 

5.4 Storage and Security

 

Recordings and transcripts are stored securely using third-party platforms. While reasonable steps are taken to protect data, no system is fully secure.

 

5.5 Participant Responsibility

 

You agree not to:

  • distribute recordings or transcripts

  • share access outside of enrolled participants

  • misuse recorded content

 

6. THINKING PARTNER SESSIONS (1:1 SERVICE)

 

Thinking Partner Sessions are structured reflective and educational sessions designed to support:

  • decision-making clarity

  • structured thinking

  • career or life direction reflection

  • values exploration

  • problem framing and action planning

 

These sessions are NOT therapy or counselling.

 

6.1 Session Nature

 

Sessions may include:

  • reflective questioning

  • cognitive reframing

  • structured thinking tools

  • goal and action planning

 

6.2 Boundaries

 

These sessions do not include:

  • psychological treatment

  • diagnosis

  • crisis intervention

  • ongoing clinical support

 

6.3 Suitability

 

If clinical needs are identified, referral to an appropriate practitioner may be recommended.

 

7. GROW A CALMER MIND PROGRAM

 

This program is an educational wellbeing and mindfulness-based learning program.

 

It may include:

  • meditation and mindfulness practices

  • nervous system awareness education

  • reflective journaling exercises

  • group discussion

  • behavioural habit formation strategies

 

Participation is voluntary, and participants may choose their level of engagement in all exercises.

 

You acknowledge that some practices may involve emotional reflection or internal awareness exercises, and you participate at your own

discretion.

 

8. CAREER DIRECTION PROGRAM

 

The Career Direction Program is an educational program designed to support:

  • career exploration

  • vocational reflection

  • values clarification

  • decision-making frameworks

  • future planning

 

This program does NOT provide:

  • employment guarantees

  • recruitment or placement services

  • psychological assessment or diagnosis

  • clinical intervention

 

Participants remain responsible for their own career, financial, and employment decisions.

 

9. FEES, PAYMENTS, AND REFUNDS

 

9.1 Fees and Payment Terms

 

All fees are payable as displayed at the time of purchase or enrolment.

 

Payment may be required:

  • upfront

  • via instalment plan

  • or according to agreed schedule

 

Access to services may be withheld until payment is received in full (where applicable).

 

9.2 Refund Policy (General Rule)

 

Due to the nature of digital and live educational services:

  • change-of-mind refunds are not automatically provided

  • refunds are assessed in accordance with Australian Consumer Law

  • statutory rights cannot be excluded

 

9.3 Program Cancellations by Participant

 

If you choose to withdraw from a program:

  • written notice is required

  • refunds (if any) will depend on timing, access provided, and statutory obligations

  • access to materials may be revoked upon withdrawal

 

9.4 Program Cancellation or Changes by Provider

 

We reserve the right to:

  • reschedule sessions

  • modify delivery formats

  • substitute facilitators

  • adjust program structure where reasonably required

 

If a program is cancelled by us, participants will be offered:

  • rescheduled access OR

  • partial refund OR

  • alternative program credit (where appropriate)

 

9.5 Payment Defaults

 

If payment is not received:

  • access may be suspended or terminated

  • outstanding balances may be pursued

  • collection costs may be recovered where applicable

 

10. CONSENT TO PARTICIPATION (INFORMED AGREEMENT)

By participating in any service, you acknowledge and agree that:

 

10.1 You understand the nature of services as educational and non-clinical.

 

10.2 You understand participation may involve:

  • reflective exercises

  • emotional or cognitive reflection

  • personal insight work

  • group discussion

 

10.3 You understand recordings and transcripts may occur where notified.

 

10.4 You voluntarily choose to participate and accept responsibility for your engagement.

 

10.5 You understand you may withdraw participation at any time, subject to financial terms.

 

10.6 You confirm that you are not relying on services as a substitute for medical or psychological treatment.

 

10.7 You agree to seek appropriate external support where needed.

 

11. CONFIDENTIALITY (GROUP SERVICES)

 

Where services are delivered in group settings, participants agree to:

  • respect the privacy of others

  • not disclose personal information shared by other participants outside the group

  • maintain confidentiality of discussions

 

However, confidentiality cannot be fully guaranteed in group environments.

 

12. INTELLECTUAL PROPERTY

 

All materials remain the intellectual property of I Learn for Life.

 

You may not:

  • reproduce

  • distribute

  • resell

  • share

  • or publicly publish materials

without written permission.

 

13. LIMITATION OF LIABILITY

 

To the extent permitted by law:

  • we are not liable for indirect or consequential loss

  • we are not responsible for decisions made based on program participation

  • outcomes are not guaranteed

Nothing in this Agreement excludes rights under Australian Consumer Law.

 

14. TERMINATION OF PARTICIPATION

 

We reserve the right to terminate or suspend access if a participant:

  • breaches these terms

  • engages in disruptive or harmful behaviour

  • misuses program materials

  • poses risk to group safety or integrity

 

Termination may occur without refund where appropriate.

 

15. PRIVACY

 

Your participation is also governed by our Privacy Policy, which explains how your personal information is collected, stored, and used.

 

16. GOVERNING LAW

 

This Agreement is governed by the laws of Queensland, Australia.
